其實﹐由於這次事件﹐網站供應商提出建議﹐ 要求每個相關屋苑找管理員負責擁有及管理討論區網站﹐並要求管理員稍後與供應商簽訂文件作實。我曾與供應商商量過﹐ 我會負責CC這個討論區。
而我在另一個同系討論區﹐關於這件事﹐ 有住戶提出以下的建議﹐當中有些是涉及網站廣告收益的分賬問題﹐值得我們這群CC住戶網民去考慮﹐ 另外如有其他住戶願意負起這責任﹐ 共同擁有及管理CC這討論區網站﹐ 請與我聯絡﹕小弟有以下建議:
可否以後限定大家, 不准任何公司以 user 名義留言作商業用途, 之前因為有某一設計公司同某網友在留言區互相指摘. 另一方面, 公司可以在此 forum 作商業推廣, 對其餘同業亦有不公及不良競爭.
可否限定各位, 不直接介紹公司的名稱, 當然 xyz, pxx, soxy 等代號是合法亦可理解的名稱亦可留言區討論.
我覺得以後少點評論某設計公司, 便可省掉被評擊的煩惱. My Complete opinion towards Lake Silver's Website (consist of 4 sets of rules)
Rule 1) Advertisment MUST be placed on our "preset" banners or "preset" spaces on this Forum which is agreed between the "Owner" or "Super-Administrator" and 香港屋網 28Hse LIMITED. And the spaces can be changed from time to time upon the mutual agreement between 香港屋網 28Hse LIMITED and us ----> **ALL the advertisement charges (or Revenue) should belong to 香港屋網 28Hse LIMITED and the Price Level should be agreed between the advertisers and 香港屋網 28Hse LIMITED but not the future Super WebMaster of this Forum. However, when we do the Handover with 香港屋網 28Hse LIMITED and LS Owners, there should be a clause that makes "Profit sharing" possible in the future. (It is because when time passes, hit-rates will reach a promise level)
Rule 2) In our Forum, ALL members cannot Represent ANY Business Entity or Profit-Oriented organizations, NOR they can mention any a) Company Names, b) Brand Names of any products, c) Developer Names, etc.
Rule 3) In our Forum, ALL members cannot "Compare", "Downgrade", "Comment" on any other 屋苑 in HK
Rule 4) In the section of "Rental" / "Buying and Selling", I strongly suggest we had better delete it because it will bring us potential troubles or Lawsuits even Disclamer Terms has been placed.
Other Rules ----> Just follow the Standard rules from major Forums... e.g. no placing of Emails, phone numbers, contacts, etc; no personal attacks, comments should be supported by data or relevant points, etc.
If all the above rules cannot be set up and clearly defined case, I the operation of our website will be okay and smooth.
Pros:
1) Hse28.com Can share the advertisment revenue and our website can continue in a permenant manner based on the backbone infrastructure provided by them. More importantly, Hse28.com can get rid of the potential Legal issues aroused from this website (that's fair to both parties)
2) That's much better to base on this website rather to start it all over again to switch another one --> it is because: a) This website has been run for more than half Year and it contains substantial extremely valuable information and Membership bases, b) Even though any one of us (LS Owner) start a new one by him/herself, similar Legal Issues will arise. **Remember, if we "say no" to Hse28.com --> that's fair we CANNOT get back most of our contents which is belonged to them actually.
Cons:
1) In the future, if the Traffics or Hit-rate of our website has reached to a very high-Level ----> **We cannot get back our Advertising Revenue since we have already signed the agreement with Hse28.com. This maybe unfavourable to us.
2) If the post of this "Super-Administrator" or "OWNER" of this website is a "NON-PAID" job (or volunteers), I don't think any of us will take this responsibility, it is because ----> ** a) Potential Legal Obligation has to be faced, b) The maintanence of of a Forum should be extremely Time-Consuming and the workload must be huge; I don't think many of us here will take this Huge Repsonsibility to be the Owner or Super-Administrator at this stage (since this website is NOT YET generating promising Revenue at this moment of time)
**As a result, I further suggest to 香港屋網 28Hse LIMITED that we can place an extra term at the moment of Handover; The Clause is ---> Profit-sharing can be possible in the future provided that the website can generate enough revenue that can i) cover the ALL basic costs of 香港屋網 28Hse LIMITED ii) give them a reasonable income; in this case, I am sure someone will take this Responsibility. Moreover, there should be a "Pool of Funds" after all "Expenses to 香港屋網 28Hse LIMITED" AND "Salaries to the Super-Administrator and relevant 板主s", this "Pool of Funds" can be used to organize Meetings or Functions or Lucky draws and so on...... that "Pool of Funds" is under the monitor of a Committee from this website. 希望大家比比意見﹗ |
